Memorandum of Understanding

Job Action Protocol

The Parties hereby agree that should the members of the (Union) take job action by going on strike before a collective agreement is reached:

  1. BUFA will tender to the University the premiums (both employer and employee) for the employee group benefits described below, on behalf of its members,
  2. payment of such premiums shall be made upon receipt of the costing of those premiums, and as required during the course of a strike, based upon the premium calculations as provided by the University,
  3. the University will ensure that the employee group benefits remain in full force and effect for the duration of such job action, to the extent allowed under those employee group plans, and
  4. the University will reimburse BUFA for any premium amounts advanced in excess of those required over the duration of the job action.

For purposes of the Memorandum of Understanding and Job action Protocol, the employee group benefit plans to be included are:

  1. TRAF
  2. Life Insurance
  3. Long Term Disability
  4. Extend. Health
  5. Accidental Death and Dismemberment Insurance,:
  6. Dental
  7. Canada Savings Bonds
  8. Parking
  9. United Way
  10. RRSP Contributions

The premiums for the Brandon University Retirement Plan shall be tender. by BUFA subsequent to the cessation of Job Action, subject to the provisions of any Back to Work Protocol.

Other Protocol Issues:

  1. Maureen Barrett will have access to the BUFA Office and associated services routinely used by her in the course of her normal duties (eg. Computer, mail, e-mail, telephone, photocopier, washrooms, etc.)
  2. Members shall have access to their regular parking, but not to mail services, office space, computers or research on campus, during the course of any job action.
  3. Sandy McMaster will continue to provide long term counselling to established clients over the course of any job action.
  4. Members shall be provided access as per Article 26.5 of the most recent collective agreement in event of any job action.
  5. Members who provide service for the Eckhardt-Gramatte Conservatory of Music shall have access to the School of Music for that purpose only.
  6. Members on approved sabbatical, or other paid leave, as of September 26, 2008 shall continue to receive pay and benefits unless they advise the Director, Human Resources, in writing, that they are on strike. Should a member make such a declaration, no extension of a sabbatical, or other paid leave, will be granted.
  7. Steve Dzubinski will provide Athletic Therapy services for athletes during practices and games and continue long-term treatment of patients during any job action.
  8. Bryan Hill will tend to the NMR machine.
  9. Linda Krieser will care for animals and any deliveries of perishable material.
  10. Mary Malainey will tend to the mass spectronomy machine in her lab.
  11. BUFA members residing in University residences will have access to their domicile.
  12. Cessation of strike/lock-out action shall proceed in accordance with a Back to Work Protocol negotiated between the Parties.
